Litigation Support
Where a dispute cannot be resolved through arbitration or mediation and proceeds to the UAE courts, ALMC provides the technical and legal insight clients need to build a strong case. Our founder, Mr. Mohamed Al Marzooqi, holds rights of audience before the Dubai Courts and the Ministry of Justice, and is a Certified Expert Witness in the UAE Courts, giving ALMC direct, firsthand standing in the litigation process rather than a purely advisory role from the sidelines.
Mr. Al Marzooqi’s grounding in UAE Commercial Law, the Civil Procedure Code and the Law of Evidence, combined with his fluency in Arabic and understanding of local culture, has made ALMC a trusted choice for government entities and national and international corporations litigating construction, real estate and related technical disputes.
Over the course of his career Mr. Marzooqi has submitted hundreds of opinions on technical matters and UAE law, with a track record of the great majority of his opinions leading to a related finding, reflecting both the rigour of ALMC’s analysis and its understanding of how UAE courts approach technical evidence. His familiarity with cassation and supreme court judgments in this field further sharpens the way ALMC frames a client’s case, helping ensure that reports and opinions are built to withstand scrutiny at every level of appeal.
Our litigation support includes:
- In-depth review of contractual and project documentation to assess how it affects a client's position
- Technical and quantum analysis to help legal counsel decide how best to progress a claim or defence
- A clear, evidence-based assessment of the value of a claim.
ALMC also has significant experience in data management and electronic discovery, including computer forensics, litigation data analysis, and email reconstruction which are increasingly important tools in construction litigation, where large volumes of project correspondence and records must be reviewed and tested.
Because proceedings before the UAE courts may be conducted in Arabic or in English, our advisers move seamlessly between both, ensuring nothing is lost in translation between the technical substance of a dispute and its legal presentation. By combining direct courtroom standing, technical precision and legal insight, ALMC helps ensure that clients heading into UAE court proceedings are fully supported, with a clear understanding of the strengths and risks of their case from the outset.
